These YapPay Mail Terms of Service govern your access to and use of YapPay Mail, a business email service provided by YapPay, a DBA of Dubau Ventures LLC.
These terms supplement the general YapPay Terms of Service and Privacy Policy. If there is a conflict specifically concerning YapPay Mail, these YapPay Mail Terms control with respect to the YapPay Mail service.
YapPay Mail provides business email services that may include:
business-domain email accounts, browser-based webmail, mailbox hosting, IMAP, SMTP, POP3, forwarding, aliases, domain configuration, mailbox management, and related account-management features.
YapPay may use third-party infrastructure, hosting providers, email-service providers, telecommunications providers, and other vendors to deliver portions of the service.
YapPay may change underlying service providers without materially changing the customer's purchased YapPay Mail service.
Customers are responsible for owning, controlling, or having authorization to use any domain connected to YapPay Mail.
Customers are responsible for maintaining accurate DNS records and domain registration.
YapPay may provide DNS instructions, but the customer remains responsible for changes made at the customer's registrar, DNS provider, or hosting provider.
A billable mailbox is an active email account with its own mailbox storage and login credentials.
Aliases, forwarding addresses, and domain pointers do not count as separate billable mailboxes unless otherwise stated.
The standard YapPay Mail mailbox includes 1 GB of storage.
Additional storage options may be offered separately.
YapPay Mail has a monthly platform fee of:
$14.95 per account
Mailbox pricing is based on the number of active billable mailboxes associated with the account:
1–100 mailboxes: $0.50 per mailbox per month
101–1,000 mailboxes: $0.40 per mailbox per month
1,001 or more mailboxes: $0.30 per mailbox per month
The pricing tier reached by the customer's active mailbox count applies to all active billable mailboxes for that billing period.
YapPay may change pricing by providing notice before the new pricing becomes effective.
YapPay Mail is a variable recurring billing service.
By purchasing YapPay Mail, the customer authorizes YapPay to charge the customer's selected payment method for:
the applicable monthly platform fee, the applicable mailbox charges, and any other services or charges authorized by the customer.
The customer's monthly charge may vary based on the number of active billable mailboxes and the applicable YapPay Mail pricing tier.
YapPay Mail is billed monthly.
The initial payment may be collected when the customer activates the service.
Future billing dates may be based on the original activation date or another billing date established by YapPay.
If mailbox usage changes, the amount due for a future billing period may also change.
If payment is declined, reversed, disputed, or otherwise unsuccessful, YapPay may:
retry the payment, request another payment method, restrict account features, suspend mailbox creation, suspend access to the service, or terminate the YapPay Mail account.
YapPay may restore service after outstanding balances are paid.
Customers may request cancellation of YapPay Mail through their YapPay Mail account, through YapPay support, or by contacting YapPay using the contact information published on the YapPay website.
Cancellation stops future billing after the applicable cancellation effective date.
Unless otherwise required by law or specifically agreed in writing, cancellation does not automatically create a refund for charges already incurred.
YapPay Mail charges are generally non-refundable once the applicable billing period has started.
YapPay does not automatically prorate monthly charges when mailboxes are removed during an active billing period unless YapPay explicitly agrees otherwise.
If YapPay issues a refund or credit, the refund or credit does not create an obligation to provide similar refunds in the future.
Customers are responsible for:
maintaining accurate account information, maintaining control of their domains, protecting mailbox credentials, managing authorized users, removing former workers or affiliates, maintaining backups where appropriate, and complying with applicable law.
Customers are responsible for all activity occurring through mailboxes created under their YapPay Mail account.
YapPay Mail is intended for legitimate business communications.
Customers may not use YapPay Mail for:
unsolicited bulk email, spam, phishing, fraudulent communications, malware distribution, illegal activity, harassment, impersonation, deceptive marketing, unauthorized data collection, or activity that violates applicable law or third-party rights.
YapPay Mail is not designed to function as a bulk-email marketing automation platform.
Customers who require marketing campaigns should use an appropriate CRM, marketing automation system, or commercial email-marketing service.
YapPay or its infrastructure providers may apply sending limits, rate limits, abuse thresholds, spam controls, reputation safeguards, or other technical restrictions.
YapPay may reduce, suspend, or restrict sending if activity threatens deliverability, infrastructure stability, service reputation, or compliance.
Mailboxes are subject to the storage allocation purchased or included with the customer's service.
When a mailbox reaches its storage limit, the mailbox may stop receiving new messages or may experience limited functionality until storage is reduced or increased.
YapPay may offer additional storage for an additional fee.
Customers are responsible for exporting or preserving email data they need before cancellation or termination.
After cancellation or termination, YapPay may delete mailbox data after a reasonable retention period.
YapPay does not guarantee indefinite retention of cancelled or terminated mailbox data.
YapPay uses commercially reasonable measures designed to protect account systems and service infrastructure.
Customers remain responsible for protecting mailbox passwords, devices, user access, and account credentials.
Customers must promptly notify YapPay if they suspect unauthorized access.
YapPay does not guarantee uninterrupted or error-free email service.
Service may be temporarily unavailable because of:
maintenance, third-party outages, DNS problems, internet failures, infrastructure incidents, spam mitigation, security measures, or events outside YapPay's reasonable control.
YapPay may use third-party providers to operate mail servers, data centers, payment systems, network infrastructure, spam filtering, DNS functionality, or other components.
The use of third-party infrastructure does not create a direct contractual relationship between the customer and the third-party provider unless otherwise stated.
YapPay may suspend or restrict service when necessary because of:
nonpayment, abuse, suspected fraud, spam activity, compromised accounts, legal requirements, security concerns, infrastructure risk, or violations of these Terms.
YapPay may terminate YapPay Mail service for material violations of these Terms, repeated abuse, nonpayment, fraud, illegal activity, or activity that poses a material risk to YapPay, other customers, infrastructure providers, or third parties.
YapPay Mail support is available through the customer portal or the support channels published by YapPay.
Support response times may vary based on issue severity and service conditions.
YapPay's collection and use of personal information related to YapPay Mail is governed by the YapPay Privacy Policy.
YapPay may process information necessary to operate YapPay Mail, including:
customer information, domain information, mailbox metadata, user information, billing information, support communications, service logs, technical information, and security-related data.
To the maximum extent permitted by applicable law, YapPay is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of YapPay Mail.
YapPay is not responsible for losses caused by customer configuration errors, compromised credentials, third-party systems, DNS providers, internet service providers, external email providers, or events outside YapPay's reasonable control.
YapPay may modify features, infrastructure, technical requirements, service providers, or operating procedures as the service evolves.
Material changes affecting customer pricing or contractual rights will be communicated when required.
